Gloucester County DWI Law

In Gloucester County, New Jersey, a DWI charge is a traffic ticket but it is different from a speeding ticket. An individual is charged with DWI if he/she is driving under the influence of any intoxicant that affects their thinking ability. DWI is not a criminal charge but the fees and penalties make it different from other traffic tickets.

A New Jersey DWI charge can also have a negative effect on the driving privileges of a driver driving under the influence both in New Jersey as well as their home state if he/she is not a New Jersey resident and is only driving through Gloucester County on their way to another state. Driving privileges within the state can only be suspended by the state of New Jersey under the law. A person who lives in any other state, if arrested in Gloucester County, can face DWI penalties in 2 states. New Jersey imposes a 3 months to a yearlong driver’s license suspension; the offender has to pay over $3,500 in fines and has to serve jail time for the committed offense.

When an individual is pulled over in New Jersey, the police officer observes signs if there are any which can prove that a person is under the influence. The officer issues a field sobriety test to determine the BAC level limit of an individual and he/she also asks for their blood, urine or breath sample for intoxication testing. A person cannot refuse to provide a sample as it is not permitted and refusing to do so is illegal in New Jersey. An individual has to stay silent because refusal can lead to more penalties and charges.

The BAC limit which is permitted in New Jersey is 0.08 percent and it is less if the age of the individual is less than 21 years and if he/she is driving with CDL. The presence of drugs in the blood or urine of an individual is also checked because the penalties for intoxication from drugs are higher than the penalties and fines for a BAC under 0.10 percent. After the intoxication test, the offender is taken to jail for 12 hours or until a sober person comes for their release.

The court process in Gloucester County takes almost two months. During that time period, defendants may be required to attend court 3 times and defendants with representation may only attend court twice.
